By using the Eye Physics LLC Services, you agree that we may collect this information and use, transmit, process, and store that information as described in our Privacy Policy including to provide and improve our Services.

If we combine non-Personal Data with Personal Data, the combined information will be treated as Personal Data for as long as it remains combined.

F) ACCESS AND ACCURACY OF YOUR INFORMATION

You have a right to be informed of Personal Data processed by the Service, a right to rectification/correction, erasure and restriction of processing. Upon request, you have the right to receive a structured, common and machine-readable format of the Personal Data you provided to us. This is a security measure to ensure that you are the data subject entitled to receive such Personal Data.

Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of the Service. We will endeavor to fulfill your request within 30 days but some Personal Data may persist in backup copies for a certain period of time and may be retained as necessary for legitimate business purposes or to comply with our legal obligations. You further agree that Eye Physics, LLC shall not be held liable with respect to any loss and/or damage to your Personal Data if you choose to withdraw consent.

Eye Physics takes precautions to safeguard your Personal Data against loss, theft and misuse and unauthorized access, disclosure, alteration, and destruction through the use of appropriate administrative, physical and technical security measures.

Our website and applications are scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. Your Personal Data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your Personal Data.

Personal Data and usage data is stored as long as is necessary for the purpose(s) for which we originally collected it. We may also retain information as required by law.

Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

L) Compliance with State and Federal Laws

EU General Data Protection Regulation (“GDPR”)

We carry out all data control and processing operations in strict compliance with the GDPR. We use a limited number of external service providers that are trusted and meet high data protection and security standards for certain tasks such as technical data analysis, processing and/or storage offerings. We only share information with them that is required for the services offered, and we contractually bind them to keep any information we share confidential. We will only pass your data on to third parties without your express consent or if we are obliged to do so by statutory law or an instruction a public authority or court.

California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CalOPPA we agree to the following:

Users can visit our site or apps anonymously. Once this privacy policy is created, we will add a link to it on our home page or as a minimum on the first significant page after entering our website (a link for the privacy policy for the app will be on the app store listing). Our Privacy Policy link includes the word 'Privacy' and can be easily be found on the page specified above. Users will be notified of any privacy policy changes when they login to their account.

How does our site handle “do not track” signals?:

We honor “do not track” signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Does our site allow third-party behavioral tracking?

It’s also important to note that we allow third-party behavioral tracking to improve our users’ experience. We are however NOT using any at this time.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of Personal Data from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under 13.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect Personal Data.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to provide you with occasional calculator or service updates, which you can easily opt-out from.
